Agreement to these terms

We are The Human Collab, doing business as The Human Co.(“Company,” “we,” “us,” “our”).

We operate the website thehumanco.org (the “Site”), together with the AI Embedding Diagnostic, the email insights signup, and the related systems that refer or link to these legal terms (together, the “Services”).

These Legal Terms constitute a legally binding agreement between you (whether personally or on behalf of an entity) and The Human Collab concerning your access to and use of the Services. By accessing the Services, you agree to be bound by these Legal Terms. If you do not agree, you must stop using the Services.

We may update these Legal Terms from time to time. The modified terms become effective when posted on this page, with the “Last updated” date at the top revised accordingly. By continuing to use the Services after changes take effect, you agree to the updated terms. The Services are intended for users who are at least 18 years old.

Important note on scope

These Terms govern your use of this website — specifically, your right to browse the site, read our content, use the free AI Embedding Diagnostic, subscribe to our insights list, and send us a consultancy enquiry.

These Terms do not set the commercial terms of any consultancy work. Any training, embedding, or change engagement with The Human Co. is governed by a separate written agreement entered into directly with you or your organisation. Nothing on this Site is an offer capable of acceptance, and these Terms contain no fees, pricing, or purchase terms.

1. Our Services

The Services currently consist of: this website and its content, the free AI Embedding Diagnostic, the email insights signup, and the ability to send us a consultancy enquiry. No products are sold and no payments are processed through the Services.

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Those who access the Services from other locations do so on their own initiative and are responsible for compliance with local laws.

The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.), so if your interactions would be subject to such laws, you may not use the Services.

2. Intellectual property rights

Our content

We own or license all intellectual property rights in the Services — including the source code, website design, copy, written content, images, graphics, logos, and brand marks. Our content and marks are protected by copyright and trademark laws in the United Kingdom and worldwide.

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and to download or print portions of the content for your personal, non-commercial use or internal business purpose. Any breach of these intellectual property rights will constitute a material breach of these Legal Terms and your right to use the Services will terminate immediately.

Your submissions

By sending us any question, comment, suggestion, idea, feedback, or other information about the Services, you agree we may use that feedback freely without compensation or attribution to you. You confirm that such submissions are original to you and do not violate any third party’s rights.

3. User representations

By using the Services, you represent and warrant that:

  1. All information you provide (including your email address) will be true, accurate, current, and complete;
  2. You will maintain the accuracy of such information and update it promptly when necessary;
  3. You have the legal capacity to agree to these Legal Terms;
  4. You are not a minor in the jurisdiction in which you reside;
  5. You will not access the Services through automated or non-human means (bots, scripts, scraping);
  6. You will not use the Services for any illegal or unauthorised purpose;
  7. Your use of the Services will not violate any applicable law or regulation.

If you provide information that is untrue, inaccurate, incomplete, or outdated, we have the right to suspend or terminate your use of the Services.

4. The AI Embedding Diagnostic

The AI Embedding Diagnostic is a free, interactive tool. It asks you a series of questions and may invite free-text or conversational input, then generates a tailored written result, which we send to the email address you provide.

The result is generated automatically and is provided for general information only. It is not professional, legal, financial, or other advice, and it does not create any consultancy, advisory, or other relationship between you and The Human Co. You are responsible for any decisions you make based on it. You agree not to submit confidential third-party information, personal data about other people, or special-category data into the tool, and to use it only for lawful purposes and not to attempt to disrupt, reverse engineer, or abuse it.

5. The insights list

The Site does not require you to create an account. The subscribe form asks for your email address so we can send you our insights and occasional updates. Subscribing is not a contractual commitment; you can unsubscribe at any time using the link in any email we send you. How we handle your email is described in our Privacy Policy.

6. Consultancy enquiries

You may contact us through the Site to enquire about training, embedding, or change work. Making an enquiry, and our reply, does not form a contract or commit either party to an engagement. Any engagement, and all of its commercial terms, will be set out in a separate written agreement signed by The Human Collab and you or your organisation. These Terms do not set scope, deliverables, fees, or any other engagement terms.

7. Prohibited activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

  • Systematically retrieve data or content from the Services to create a collection, database, or directory without our written permission;
  • Trick, defraud, or mislead us or other users;
  • Circumvent, disable, or interfere with security-related features of the Services;
  • Disparage, tarnish, or otherwise harm us or the Services;
  • Use any information obtained from the Services to harass, abuse, or harm another person;
  • Use the Services inconsistently with any applicable laws or regulations;
  • Engage in unauthorised framing of or linking to the Services;
  • Upload or transmit viruses, Trojans, malicious code, or any material that disrupts the Services;
  • Engage in automated use of the system (scripts, bots, data mining, scraping, harvesting email addresses);
  • Delete the copyright or other proprietary rights notice from any content;
  • Interfere with, disrupt, or create an undue burden on the Services or the networks connected to the Services;
  • Harass, threaten, or intimidate us or our staff;
  • Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any software we provide;
  • Use the Services to advertise or offer to sell goods and services not authorised by us.

8. Third-party websites and content

The Services may link to third-party websites that we do not own or control. Such third-party websites and content are not investigated or monitored by us, and we are not responsible for their content, accuracy, opinions, reliability, or privacy practices. Inclusion of a link does not imply endorsement. If you decide to leave the Services via a third-party link, you do so at your own risk, and these Legal Terms no longer govern.

9. Services management

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these Legal Terms; (3) refuse, restrict, or disable access to the Services; and (4) otherwise manage the Services to protect our rights and property and to facilitate the proper functioning of the Services.

10. Privacy policy

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. The Services are hosted in support of a UK-established business. If you access the Services from another region, your continued use constitutes consent to your data being processed as described in the Privacy Policy.

11. Term and termination

These Legal Terms remain in full force and effect while you use the Services. We reserve the right, in our sole discretion and without notice or liability, to deny access to the Services (including blocking certain IP addresses) for any reason, including breach of these Legal Terms or applicable law. In addition to terminating access, we reserve the right to take appropriate legal action, including pursuing civil, criminal, and injunctive redress.

12. Modifications and interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We have no obligation to update any information on our Services. We also reserve the right to modify or discontinue all or part of the Services without notice at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. You agree we have no liability for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance.

13. Governing law

These Legal Terms are governed by and interpreted following the laws of the United Kingdom, and the use of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by the mandatory provisions of the law of your country of residence. The Human Collab and yourself both agree to submit to the non-exclusive jurisdiction of the courts of the United Kingdom.

15. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time, without prior notice.

16. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES’ CONTENT, INCLUDING ANY RESULT GENERATED BY THE AI EMBEDDING DIAGNOSTIC, AND WE ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT MADE AVAILABLE VIA THE SERVICES.

17. Limitations of liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE LEGAL TERMS EXCLUDES OR LIMITS OUR LIABILITY WHERE IT WOULD BE UNLAWFUL TO DO SO, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE OR FOR FRAUD. CERTAIN UK AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IF THOSE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

18. Indemnification

You agree to defend, indemnify, and hold us harmless — including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees — from and against any loss, damage, liability, claim, or demand, including reasonable legal fees, made by any third party due to or arising out of: (1) your use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties set forth in these Legal Terms; or (4) your violation of the rights of a third party, including intellectual property rights.

19. User data

We will maintain certain data that you transmit to the Services (such as your email address and any input you submit) for the purpose of managing the Services, as described in our Privacy Policy. You are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services.

20. Electronic communications, transactions, and signatures

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communication be in writing.

21. Miscellaneous

These Legal Terms and any policies or operating rules posted by us on the Services constitute the entire agreement and understanding between you and us regarding the Services. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. If any provision of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity of the remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms or use of the Services.
